gnosis-echo Terms of Service
Established: October 27, 2026
This is an English translation provided for convenience. If it differs from the Japanese version, the Japanese version prevails.
These Terms of Service (the "Terms") set out the conditions for using gnosis-echo, provided by gnosis LLC ("we"). They apply to anyone who agrees to the Terms and uses the Service (a "user"). Article 3 covers how the Terms relate to rights under the License.
Article 1 (Definitions)
- "Software" means the gnosis-echo desktop application and command-line tool distributed by us, including their updated versions.
- "Service" means the Software, the website we operate (gnosis-echo.com), and other services we provide in connection with the Software.
- "Verification target" means a website, application, or other service that a user operates, records, tests, or investigates using the Software.
- "Modified version" means software created by someone other than us by changing the source code of the Software.
Article 2 (Application and agreement)
- Users use the Service after agreeing to the Terms and the Privacy Policy. A user is deemed to have agreed to the Terms when they complete the agreement step on first launch of the Software.
- If a user is a minor, they must obtain the consent of a parent or other legal representative before using the Service.
- If a user uses the Service on behalf of a corporation or other organization, the user represents that they have the authority to bind that organization to the Terms.
Article 3 (Software license)
- The source code of the Software is published under the Apache License, Version 2.0 (the "License"). Rights to copy, modify, and redistribute the Software are governed by the License.
- The Terms set out the conditions for using the Service we provide and do not restrict the rights granted by the License. If the Terms conflict with the License, the License prevails with respect to rights under the License. Agreeing to the Terms is not an additional condition for obtaining rights under the License. Rights under the License are not lost solely because a user does not agree to the Terms.
- The License does not grant permission to use our trade name, product names, or logos, except as required for reasonable and customary use in describing the origin of the Software and reproducing the content of the NOTICE file (Section 6 of the License).
Article 4 (Verification targets)
- Users may make a service a verification target only if they operate it themselves or have been authorized by its administrator to verify it.
- Users must comply with the terms of service and other conditions of each verification target, and use the Software with care so as not to cause harm to the verification target or its users.
- Disputes concerning a verification target that arise from causes attributable to the user are to be resolved by the user at their own responsibility. Damage arising from causes attributable to us is governed by Article 12.
Article 5 (Features that protect users)
- To reduce misuse and accidents, we may implement measures in the Software such as restricting access to sites and traffic we designate, adding information indicating that access comes from the Software, and restricting traffic to analytics and advertising we designate. The measures available and what they cover vary with the version of the Software, the operating environment, and settings.
- These measures do not detect or prevent every dangerous site, communication, or operation. Users should confirm the authority and scope of their verification and, where necessary, use test environments and test data. Whether or not these measures are in place, the obligations in Articles 4 and 6 still apply.
- We may add to or change these measures. If a change affects the conditions of use, Article 15 applies. For access restrictions, please contact us at the address in Article 17.
Article 6 (Prohibited conduct)
When using the Service we provide, users must not engage in the following conduct. This Article also applies to the use of a service we operate when connecting to it from a modified version. This Article does not impose additional restrictions on modifying or redistributing the software or on other rights under the License.
- Operating, testing, or investigating a service for which the user does not have the authority described in Article 4, Paragraph 1
- Logging in with another person's credentials, or bypassing another person's authentication
- Conduct that violates, or may violate, the Act on the Prohibition of Unauthorized Computer Access or other laws and regulations
- Automatically performing transfers, withdrawals, trades, or other transactions on bank accounts, securities accounts, crypto assets, payment services, or similar
- Using a service we operate by improperly circumventing the access controls or usage limits we have placed on it
- Deceiving the administrator of a verification target by misrepresenting that access comes from the Software, or by removing the information that identifies it
- Placing an excessive load on the servers or networks of a verification target, or interfering with the operation of a service
- Infringing the intellectual property rights, privacy, reputation, or other rights or interests of third parties
- Distributing a modified version while presenting it as provided or approved by us
- Using the Service for criminal acts or acts connected to them
- Any other conduct that we reasonably determine to be inappropriate
Article 7 (External services)
- On the user's instructions, the Software may send information to generative AI providers the user has contracted with (Anthropic, OpenAI, Microsoft, etc.) and to other external services. The information sent includes instructions, the contents and screenshots of screens, tests, and the contents of attachments and reference materials. The handling of information at each destination is governed by the contract between the user and that provider.
- Users must comply with laws, contracts, and the rules of their organization regarding the information they send to external services, and must secure the authority needed to send it and any consent required from the individuals or other rights holders concerned. Having the authority to verify a verification target does not mean having the authority to send its information externally.
- Users should check the destination, the retention period, whether the data is used for training, handling outside their country, and similar matters, and where necessary delete, mask, or replace personal and confidential information with test data.
- We do not guarantee the content or availability of external services, or how external services handle information. However, damage arising from causes attributable to us is governed by Article 12.
Article 8 (User data)
- Tests, records, screenshots, login states, and other data created with the Software ("user data") are stored on the user's device and in the storage the user chooses (such as a Git repository). We do not obtain user data except as provided in the Terms or the Privacy Policy.
- Users are responsible for managing user data, including backups, protecting confidential information, and the scope of sharing.
Article 9 (AI output)
We do not guarantee the accuracy, completeness, or usefulness of tests, judgments, suggestions, or other output that the Software creates using generative AI. Users must review and use such output at their own judgment and responsibility.
Article 10 (Modified versions)
We have no obligation to guarantee the operation of, or to support, modifications made by anyone other than us. However, damage arising from causes attributable to us is governed by Article 12. This Article does not impose obligations on those who made modifications or on other third parties without their agreement to the Terms.
Article 11 (Disclaimer of warranties)
The Service is provided as is. We do not guarantee that the Service is free of defects, that it is fit for a particular purpose, that it will find every defect in a verification target, or that it will continue to be provided.
Article 12 (Limitation of liability)
- We are not liable for damage suffered by users in connection with their use of the Service, except where caused by our intent or gross negligence.
- Notwithstanding any other provision of the Terms, if the contract between a user and us is a consumer contract as defined in the Consumer Contract Act, we are liable, within the scope of ordinarily arising direct damage, for damage suffered by the user due to our negligence (excluding gross negligence).
- The disclaimers and limitations of liability in the Terms do not apply to damage caused by the intent or gross negligence of us, our representatives, or our employees.
Article 13 (Suspension of use)
If a user violates the Terms, or if we reasonably determine that a user may violate them, we may suspend all or part of the Service without prior notice.
Article 14 (Paid services)
If we provide any part of the Service for a fee, the fee, payment method, and other conditions will be set out separately from the Terms.
Article 15 (Changes to the Terms)
- We may change the Terms in accordance with Article 548-4 of the Civil Code.
- When we change the Terms, we will announce the changed content and its effective date in the Software and on our website a reasonable period before the effective date.
- The Software will ask for agreement to the changed Terms again.
Article 16 (Miscellaneous)
- Users may not transfer their position or rights and obligations under the Terms to a third party without our written consent.
- If any part of the Terms is found invalid or unenforceable, the remaining parts continue in effect.
- The Terms are governed by the laws of Japan. The Gifu District Court has exclusive jurisdiction as the court of first instance for disputes arising in connection with the Service.
